2A for Today | State Legislators Working to Restore God-given Rights

Federal overreach has relentlessly eroded the God-given and constitutionally protected right to keep and bear arms, yet liberty-minded state legislators are seeking to restore the rights the Founders recognized as unalienable. Legislators in Idaho and West Virginia have introduced landmark bills that reaffirm the fundamental God-given right to self-defense and challenge unconstitutional federal restrictions on firearms.

Idaho Self-defense Protections

Idaho’s Senate Bill 1298 (SB 1298), the “Stand Your Ground Shield Act,” was introduced on February 16 by state Senator Christy Zito (R-Mountain Home), who has earned a cumulative 100-percent score on The New American’s Freedom Index.

If enacted, SB 1298 would grant immunity from criminal prosecution for anyone who uses justified force under existing self-defense statutes. In the bill’s Statement of Purpose, Zito explained that it would “provide strong legal protections for individuals who use force in lawful self-defense, defense of others, or defense of certain places…. As the bill states, a person using justified force ‘shall be immune from any criminal prosecution for the use of such force or threat of force.’” The bill would establish a pretrial immunity hearing at which a judge must dismiss charges with prejudice if the defendant makes a prima facie showing of justified force.
