In a major victory for national sovereignty, a Polish court has ruled that the nation’s constitution and laws override European Union law when they contradict one other.
On October 7, the Constitutional Tribunal — Poland’s constitutional court — ruled that Poland’s constitution and laws take precedence over EU laws. The ruling, which the court had delayed multiple times, resulted from a lawsuit brought by Poland’s prime minister, Mateusz Morawiecki, in order to prevent Polish courts from using EU law to strike down the government’s recent judicial reforms. The government had urged the court to rule the way it ultimately did.
In its ruling, the tribunal stated that, “The effort by the Court of Justice of the European Union [CJEU] to interfere in the Polish justice system violates the principle of rule of law, the principle of the primacy of the Polish constitution as well as the principle of retaining sovereignty in the process of European integration.”
Poland’s concerns are not hypothetical. The CJEU has already ruled multiple times that the country’s judicial reforms likely violate EU law. Additionally, Poland risks losing EU funds, partially because several of its regions have declared themselves as “LGBT-free zones.”
EU Reacts
Unsurprisingly, globalist EU leaders reacted negatively to the ruling. In a statement the following day, European Commission President Ursula von der Leyen stated she was “deeply concerned” by the ruling and would examine it to determine the EU’s response. On Monday, Věra Jourová, the European Commissioner for Values and Transparency, claimed that “the whole Europe will start collapsing” if the increasingly-centralized bloc doesn’t challenge the ruling.
Poland’s more liberal neighbors also attacked the ruling. For example, the foreign ministers of Germany and France issued a statement claiming that “membership of the European Union goes hand in hand with a complete and unconditional adherence to common values and rules.” Ironically, Germany’s highest court issued a similar ruling last year, finding that actions by the European Central Bank violated German law.
However, others spoke in favor of the Polish ruling. Hungarian prime minister Viktor Orbán, who faces his own conflicts with the EU, signed a decree on October 9 welcoming the decision and calling on the EU to “to respect the limits of the sovereignty of the Member States in their operations.”
Leaving the EU?
Following the decision, the globalist media speculated that it could lead to Poland’s exit from the EU — termed “Polexit” — as did pro-EU protestors. While such an action would be beneficial for protecting Polish independence, Prime Minister Morawiecki denied any government plans to leave the bloc.
Regardless of what action Poland takes, the EU is one of the greatest threats to national sovereignty today. Its creation was backed by the CIA with the intention of creating a European superstate, and it continues accumulating an increasing amount of power at the expense of its member nations. Additionally, the EU is at the forefront of violating individuals’ God-given freedoms, with its judiciary ruling in favor of forced vaccination and against homeschooling, for example.
If Europe’s nations and citizens wish to preserve what’s left of their freedom and sovereignty, it is imperative that they take immediate action to counter and reverse the EU’s war on freedom and sovereignty. The Polish Constitutional Tribunal’s ruling is a good start.
