Republicans Write Legislation to Keep Biden Off Ballot in Three Crucial States

Some Republicans, incensed by Democrats’ seeming effort to thwart the Constitution and the will of voters, have decided to give Democrats a taste of their own medicine.

GOP lawmakers in the states of Georgia, Arizona, and Pennsylvania have presented legislation that would take Joe Biden off the ballot in their states, a response to ruling by the Colorado Supreme Court this week that takes Donald Trump off the primary ballot on the grounds that he engaged in insurrection against the United States and is therefore ineligible for office under Section 3 of the 14th Amendment, which reads:

No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

Colorado has not been won by a Republican presidential candidate since 2004, when George W. Bush won the state. With every election year, it has gotten progressively more blue. Trump lost the state in both 2016 and 2020; keeping Trump off the Colorado ballot in 2024, while problematic from constitutional, legal, and moral perspectives, would arguably be inconsequential as far as electoral math.

On the contrary, Georgia, Pennsylvania, and Arizona are toss-up states that are expected to determine the outcome of the presidential election. Trump won all three states — and the presidency — in 2016. He lost them, along with the election, in 2020.

The bills to bar Biden from the ballot were written in their respective state legislatures by the following Republicans: Pennsylvania Representative Aaron Bernstine, Georgia Representative Charlice Byrd and Arizona Representative Cory Mcgarr.

In a statement to Breitbart News, the lawmakers said, “We are joining forces to introduce legislation to REMOVE Joe Biden from the ballot in Georgia, Arizona, and Pennsylvania. The absurdity of radical Democrat judges removing Donald Trump from the ballot in Colorado will be a stain on the American political system for decades. By their very own interpretation of the law, Joe Biden is 100% not eligible to run for political office.”

The three lawmakers could potentially be joined by others. Texas Republicans have also threatened to cut off Biden’s access to the ballot, given his stances when it comes to immigration and border policy, but have not yet taken action.

Bernstine, Byrd, and Mcgarr added:

Democrats’ insane justification to remove Trump can just as easily be applied to Joe Biden for his ‘insurrection’ at the southern border and his alleged corrupt family business dealings with China.

Colorado radicals just changed the game and we are not going to sit quietly while they destroy our Republic. To be clear, our objective is to showcase the absurdity of Colorado’s decision and allow ALL candidates to be on the ballot in all states. To do that, we must fight back as Republicans against the communists currently running our great country.

So far, lawsuits challenging the candidacy of Donald Trump have been filed in more than 25 states. The decision in Colorado was 4-3 against Trump. 

“We conclude that because President Trump is disqualified from holding the office of President under Section Three, it would be a wrongful act under the Election Code for the Secretary to list President Trump as a candidate on the presidential primary ballot,” reads the unsigned opinion from the Colorado Supreme Court majority. “Therefore, the Secretary may not list President Trump’s name on the 2024 presidential primary ballot, nor may she count any write-in votes cast for him.”

The decision is not surprising. Such an attempt to undermine voters by keeping Trump off the ballot is precisely the type of action Democrats have been laying the foundation for all along with their rhetoric painting January 6 as an “insurrection” and Trump as an “insurrectionist.” It’s nothing short of a plot to disenfranchise American citizens by saying who they may and may not vote for.

Speaking to Breitbart, political strategist Cliff Maloney said, “While GOP elites are asleep at the wheel, the Democrats are very serious about destroying the American Republic. Thank God for patriots like Aaron Bernstine, Charlice Byrd, and Cory McGarr for stepping up to FIGHT back.”

Indeed, many feel that it is essential that Republicans demonstrate a willingness to use against Democrats the same tactics that are presently being employed against the GOP. If they do not, the Left will only be further emboldened to destroy what’s left of American elections with impunity. 

But Democrats have also opened up a can of worms. This tit-for-tat could lead to an unprecedented crisis in which several states across the nation, red and blue, have one of the major candidates left off the ballot. If this happens, the distrust and division it would provoke could very well lead the Union into permanent disunion.
