Republicans Refuse to Back Down on Ending Birthright Citizenship

Republicans are not giving up on ending birthright citizenship.

While the Supreme Court may have ruled that children born on U.S. soil to illegal aliens are automatically American citizens, the GOP is working to force the issue back onto the judges’ docket in the hopes of a different outcome.

One of the ways they’re doing that is by trying to push a vote on the Birthright Citizenship Act of 2025. Wisconsin Rep. Glenn Grothman, one of a slew of co-sponsors, told Just the News on Thursday that he hopes for a vote on the bill as early as this month.

The bill’s summary — just three paragraphs long, two of which are single sentences — cuts to the chase. “This bill limits birthright citizenship by redefining what it means to be subject to the jurisdiction of the United States,” it says. The new law would limit citizenship to someone “born to a parent who is (1) a U.S. citizen or national, (2) a lawful permanent resident residing in the United States, or (3) a non-U.S. national (alien under federal law) with a lawful immigration status who is performing active service in the Armed Forces.”

The Supreme Court on June 30 upheld by a vote of 6-3 birthright citizenship. The dissenting judges were Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch. The decision torpedoed President Donald Trump’s executive order that sought to end birthright citizenship, which he signed on his first day back in office. The order was never implemented because it was quickly challenged in a lawsuit filed by the ACLU. Trump immediately called for legislation to right what SCOTUS got wrong.

Original Intent

As we’ve pointed out, the original intent of the citizenship clause was to ensure citizenship to blacks following the Civil War. Senator Jacob Howard, the author of the clause in the 14th Amendment, said outright that the intention was not to include persons “born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons.”

Justice Thomas bolstered support for the original intent in his dissenting opinion. By upholding birthright citizenship, “the Court adds to the sad history of the Fourteenth Amendment,” he wrote, “which was designed and understood to secure equal rights for the freed blacks but has instead been repurposed for political projects that the Reconstruction Congress did not support.”

Trump reiterated his diligence on the issue earlier this week, when he said he would ask the Supreme Court for a rehearing. In a long social media post, Trump claimed that billboards advertising birthright citizenship were popping up along the southern border. He added:

Billions of Dollars will be illegally made by this SCAM, with Citizenship going to anyone willing to pay. It will be, by far, the number one way of becoming a citizen, and then the entire family will be allowed to follow. Not sustainable. NOBODY SAW THIS COMING!!! AMERICAN CITIZENSHIP IS NOT FOR SALE!

A rehearing isn’t probable. But, as Grothman pointed out, it would be more likely should the Republicans pass their bill. If that were to happen, there’s a good chance it would be challenged, possibly setting up a second look by SCOTUS.

Among the judges who voted in favor of birthright citizenship, Justice Brett Kavanaugh suggested the legislature as a vehicle of change instead of the Court:

Congress could — consistent with the Fourteenth Amendment — amend [the Immigration and Nationality Act] or otherwise enact new legislation establishing exceptions to birthright citizenship for children born to foreign citizens unlawfully or temporarily in the country. But Congress has not yet done so.

“Birth Tourism”

Trump’s allegation of “birth tourism” scams may have been based on a Fox News report saying that, after the decision, a Texas hospital “advertised Spanish-language ‘Birth Packages in South Texas’ on billboards in Mexico promoting childbirth services to pregnant foreign nationals near the U.S.-Mexico border.” The news report included a photo of a Spanish-language billboard advertising birth packages at Mission Regional Medical Center. Fox continued:

Mission Regional Medical Center confirmed to Fox News that it was responsible for the advertising campaign, which promoted deliveries starting at $3,950 for a natural birth and $5,525 for a C-section, and directed viewers to a website, havemybabyinTEXAS.com, which has since been taken offline.

In response to the SCOTUS decision and reports of birth-tourism schemes, a Texas representative called for a special session to make birth tourism a felony. State Rep. Brian Harrison announced on his X account, “I am publicly demanding an immediate special session to combat the harms from mass birth tourism, pressure the federal government to fix birth tourism, and to protect the value of citizenship that countless paid the ultimate price for.” He called for specific actions, including that Texas “make it a felony to operate or participate in birth tourism within our borders,” criminalize illegal entry “for purposes of birth tourism,” and stop giving birth certificates to children of noncitizens.

Deporting Illegals

Meanwhile, Department of Homeland Security Secretary Markwayne Mullin appears to be working hard to send back as many illegals as possible. He said he aims to deport one million in 2026 alone. DHS said last December that 2.5 million illegals left the United States in 2025, with 1.9 million of those voluntarily deporting.

Mullin’s job may be easier thanks to a SCOTUS decision that terminates temporary protected status for Haitians and Syrians.

Danger of Mass Migration

The danger of mass migration cannot be overstated. As the parent company of this magazine, The John Birch Society, notes, the core point of mass migration is to fundamentally change the national character of America. As JBS explains:

The Deep State and globalist elites understand that the vast majority of individuals from other countries and cultures have no knowledge or understanding of the U.S. Constitution and the philosophical principles held by the founding fathers. By importing these individuals en masse, which prevents their assimilation into American philosophy and culture, the elites are able to reshape the nation to their liking.

What’s happening here is similar to what’s occurring in Europe. Mass migration is a globalist tool of destruction that harms nations in several ways. It brings in criminals, increases the costs of healthcare, reduces housing, and, in the long run, enlarges an electorate that doesn’t subscribe to Western values.

For the globalists, the goal is to destabilize rich countries inhabited by people who value individual liberty. In order to usher in their one-world collectivist government, they have to destroy those countries.
