Court Blocks Law Banning “Trans” Procedures for Kids
On December 11, reported the Daily Montanan, Montana’s Supreme Court upheld a lower court’s ruling that blocked the implementation of a 2023 state law banning procedures such as “gender reassignment” surgeries on children.
A Missoula County district court had granted a preliminary injunction against the bill — SB99, the “Youth Health Protection Act” — in September 2023, and last month, the Supreme Court affirmed that the lower court was correct. Only one of the seven justices dissented.
The high court in Big Sky Country cited the state’s “right to privacy” as the reason for blocking implementation of the new law: “The right of individual privacy is essential to the well-being of a free society and shall not be infringed without the showing of a compelling state interest…. We affirm [the lower court’s] grant of a preliminary injunction on the basis of Plaintiffs’ right to privacy claim.”
