Wisconsin Democrat Activists filed suit earlier this month in an attempt to disqualify Republican Senator Ron Johnson and two GOP congressional colleagues — Representatives Tom Tiffany and Scott Fitzgerald — off the midterm ballot this November. The Democrats claim that the three pro-Trump Republicans should be disqualified to serve owing to Section 3 of the 14th Amendment, which was adopted in the aftermath of the Civil War to (in part) keep former Confederates from serving in Congress.
The relevant section of the 14th Amendment states: “No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who,having previously taken an oath, as a member of Congress, or as an officer of the United States,or as a member of any State legislature, or as an executive or judicial officer of any State,to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given.”
The suit claims that Johnson, Tiffany, and Fitzgerald “used their public positions of authority to illegally foment an atmosphere meant to intimidate and pressure Vice President [Mike] Pence and Congress to take actions inconsistent with the facts and with their duties under the Electoral Count Act and the U.S. Constitution.”
Johnson told the Epoch Times that the suit was “total nonsense.”
“Democrats have ignored the Summer 2020 riots and relentlessly used January 6th as a political cudgel,” Johnson said. “Now, they’ve used January 6th to file a frivolous lawsuit against me, similar to the one dismissed by a court last week.
In the Eastern District of North Carolina, 11 North Carolina voters challenged freshman GOP congressman Madison Cawthorn’s candidacy over the same section of the 14th Amendment. The North Carolina Democrats claimed that the wheelchair-bound Cawthorn helped to spur the vastly overblown unrest, which occurred at the Capitol on Jan Gary 6, 2021. The claims were rejected by Judge Richard Myers. A federal appeals court is currently mulling that decision.
Indiana Democrats also attempted to remove Representative Jim Banks’ (R) name from the ballot in another failed attempt.
According to the Wisconsin lawsuit, Johnson.Tiffany and Fitzgerald were guilty of spreading “malicious falsehoods about a ‘rigged election.”
The suit also claims that the three lawmakers used their “their powers as public officials and their respective bully pulpits to undermine public trust in the outcome of the election and to enable a criminal scheme to institute fraudulent electors (in Wisconsin and elsewhere) to manufacture a constitutional crisis on January 6, 2021, over how to count the electoral ballots.”
A forensic audit of the 2020 general election headed by former Wisconsin Supreme Court Justice Michael Gableman is ongoing despite Democrat attempts to derail the investigation into improprieties surrounding the election, particularly Facebook’s Mark Zuckerberg’s possible use of bribery in certain Wisconsin jurisdictions.
The lawsuit further claims that Johnson, Tiffany and Fitzgerald were guilty of spreading “falsehoods … about the integrity of Wisconsin’s election procedures began even before citizens were allowed to cast their ballots in the 2020 Presidential Election and continued long after their lies were disproven.” Also, the suit claims that the defendants “repeatedly proclaimed lies about the election and its results, and those lies increased in frequency and intensity as January 6, 2021, approached.”
Exactly what those “lies” were is not laid out in the court documents.
Fitzgerald is also accused of supporting an effort to send an alternate group of pro-Trump electors to Washington and allegedly acquiring a rooms for those “faudulent electors” to meet at the Wisconsin State Capitol on December 14 of 2020.
The lawsuit is being funded by the far-left Democrat agitator group, the Minocqua Brewing Company, which manufactures Biden Beer, Bernie Brew, AOC IPA, and Filibuster Ale. The group and the brewery’s owner and founder Kirk Bangstad, recently sent out a press release in which he begged for money to help fund the facetious effort.
“I’m thinking, all told, this suit could cost $300,000 to fight over the next six months, which is a lot of money to give to lawyers. But it’s not just lawyers — it’s a small army of staff also doing a lot of leg work, and believe me, these guys are smart and passionately committed to bringing justice to Wisconsin and America,” Bangstad groveled.
January 6, 2021 is the gift that keeps on giving for Democrats. The news media continues to refer to the unrest as an “insurrection,” though to this point, no one has been charged with that specific crime, although the more nebulous crime of “seditious conspiracy” has been thrown around some. It’s simply Democrat and media lies that keep this false narrative alive.
