Biden Said He Would Make Roe v. Wade “The Law of the Land”

Speaking at a town hall event in Miami on October 5, Democratic presidential nominee Joe Biden, was asked what he would do if Supreme Court nominee Judge Amy Coney Barrett were if confirmed and helped to overturn Roe v. Wade decision that struck down many state and federal laws restricting abortion. 

“Number 1, we don’t know exactly what she would do. Although, the expectation is that she may very well overrule Roe,” Biden replied. “The only response to that would be to pass legislation making Roe a law of the land. That’s what I would do.”

President Trump was quick to react to Biden’s statement, tweeting: “Joe Biden just took a more Liberal position on Roe v. Wade than Elizabeth Warren at her highest.”

“He also wants to PACK our great United States Supreme Court. This is what the Dems will do. Remember as they try changing positions before elections end. GET OUT AND VOTE!,” the president added.

An October 6 Forbes report noted that Biden has repeatedly stated his position on Roe v. Wade on multiple occasions while campaigning this year.

Biden said during a February Democratic primary debate in Manchester, New Hampshire, that if the Supreme Court ruled that abortion was unconstitutional, he would initiate writing Roe v. Wade into U.S. law. 

“If they ruled it to be unconstitutional, I will send it to the United States Congress, and it will pass I believe, a bill that legislates Roe v. Wade adjusted by [Planned Parenthood v.] Casey,” Biden said. “It’s a woman’s right to do that. Period.”

Since Trump also referred to Warren, it is interesting to read what she said during that February debate, as well.

“If we are going to protect the people of the United States of America, and we are going to protect our rights to have dominion over our own bodies, then it’s going to be we can’t simply rely on the courts,” she said. “Three out of every four people believe right now that the rule of Roe v. Wade should be the law. That means we should be pushing for a congressional solution as well. It is time to have a national law to protect the right of a woman’s choice.”

Forbes noted that Biden has also played up his role in rejecting former President Ronald Reagan’s Supreme Court nominee, Robert Bork, when he was in the Senate. Democrats at the time argued that if Bork, a conservative, was on the court, he would vote to roll back abortion legalization. 

An April 9 article in The New American quoted the president of the national pro-life group Susan B. Anthony (SBA) List, Marjorie Dannenfelser, who said: “It has long been clear that [Biden] would be as extreme as they come on abortion, no matter what.”
