Oh, the irony of perpetrators going after their victims, and winning.
Journalist and anti-abortion activist David Daleiden continues his years-long battle against the Goliath of Planned Parenthood and now-Vice President Kamala Harris, who have flipped the script to make Daleiden the criminal for exposing the reprehensible actions of selling baby body parts.
The Scandal Uncovered
It was the year 2000 when news first broke of “big money” being made through the sale of fetal body parts.
Fast forward to 2015, when journalist Daleiden, founder of the Center for Medical Progress (CMP), realized his 30-month-long “Human Capital” investigation, tracing Planned Parenthood’s illegal sale of body parts from aborted fetuses.
Posing as a buyer of fetal tissue, he unleashed shocking undercover footage exposing Planned Parenthood’s abortion doctors discussing cavalierly over lunch in a California restaurant partial-birth abortions used to procure and traffic baby body parts (i.e., hearts, livers, brains, lungs, and other tissue).
In case you’re wondering, the sale of human body parts is a federal felony, punishable by up to 10 years in prison and $500,000 in fines.
Yet Planned Parenthood is not the one on trial. In fact, the organization has never been prosecuted or even rebuked. Instead, it has dug in with money and allied with powerful politicians, such as Vice President Kamala Harris, who, as then-California Attorney General, brought criminal charges against Daleiden, which he’s been fighting for nearly six years.
Indeed, organizations such as Planned Parenthood and the National Abortion Federation (NAF) have long been protected by Democratic allies and judges and won many battles, keeping hidden from the American public damaging information that would expose their wrongdoing and most certainly rock the nation.
Ongoing litigation against Daleiden by Planned Parenthood and the NAF, and vice versa, began in July 2015, upon the release of Daleiden’s first undercover video. Presiding over this initial case was Obama-appointed San Francisco District Judge William Orrick, who issued an emergency restraining order blocking the distribution of the undercover videos. Unsurprisingly, this ruling favored the NAF, which claimed “harassment, intimidation, and even violence” if CMP distributed the offensive material.
Orrick, a longtime financial supporter of Planned Parenthood, who should have recused himself from the case, went on to extend the ban, effectively keeping more than 200 hours of damning footage gathered on abortion providers silenced and out of the public’s reach.
In retaliation, Daleiden accused the NAF and Planned Parenthood of information suppression and stifling his right to free speech. “The CMP follows all applicable laws in the course of our investigative journalism work and will contest all attempts from Planned Parenthood and their allies to silence our First Amendment rights,” he said a statement.
To this day, Daleiden’s cases with the NAF and Planned Parenthood remain tied up in the courts.
In May 2020, Daleiden sued then-Senator Kamala Harris, then-California Attorney General Xavier Becerra (now Health and Human Services Secretary under the Biden administration), the California Attorney General’s Office, Planned Parenthood, and others for singling him out owing to the content of his videos, and for violating his First and 14th Amendment–protected civil rights.
Citing clandestine 2016 meetings between then-California Attorney General Harris and Planned Parenthood executives conspiring to investigate Daleiden and seize his video equipment and unpublished footage, the lawsuit alleges “selective prosecution,” a claim political judge Orrick is likely to dismiss, as he continues to preside over litigation involving both parties. Among these cases are Planned Parenthood’s $16 million civil lawsuit against Daleiden, which he appealed in the Ninth Circuit court, and NAF’s request for a “permanent ban on the videos solely because of the way it will harm their reputation,” according to the Federalist.
In reference to the latter, the Federalist reported that during a February 17 hearing, Orrick deliberated over whether to make permanent a preliminary injunction he issued in 2016. “The real question I’m interested in is the scope of the injunction,” he said. “I think the general arguments that the defendants have raised against injunctive relief aren’t persuasive.”
Planned Parenthood Buys More Time
As of Wednesday, March 24, Judge Orrick once again seemed unlikely to advance Daleiden’s case. According to Lifenews, Orrick refused to make a ruling that day, citing pending litigation from 2016 involving Daleiden and Planned Parenthood as the reason.
Additionally, Courthouse News reported that lawyers for the state argued the suit should be dismissed entirely as “time-barred” because “the complaint was filed more than two years after Daleiden obtained evidence supporting his selective prosecution claims” and “because California makes a compelling case for prosecutorial immunity.”
Appearing in a virtual courtroom of a San Francisco Criminal court, Orrick said, “It does make sense to me that a good portion of this case, if not the whole thing, ought to be stayed until we know what’s going to happen in the Ninth Circuit and the criminal case.”
Daleiden argued that in 2016, the California state legislature amended the state’s recording law to include the prohibiting of the publication of any “confidential communication” of a healthcare provider. His lawyers posited that this amendment is an unconstitutional regulation that bars his right to free speech.
According to Courtroom News, Daleiden’s attorney, Peter Breen of the Thomas More Society, claimed, “Our position is this is a content-based regulation on speech subject to strict scrutiny. We have a pretty strong argument to strike it down.”
In 2019, Daleiden was prosecuted on first-ever charges of unlawfully gathering news footage under California’s recording law. According to a San Francisco County judge, Daleiden violated the 1967 California penal code §632, a law punishable by up to a year in prison and $2,500 in fines, even though local law enforcement found Daleiden’s videos perfectly legal.
Daleiden is reportedly the first journalist ever to be prosecuted for violation of this law. On February 21, 2020, Daleiden and colleague Sandra Susan Merritt were arraigned on 10 counts of criminal eavesdropping and conspiracy to invade privacy. They pled not guilty in the San Francisco Superior Court. According to the Thomas More Society, then-California AG Becerra’s “criminal complaint included multiple allegations of illegal recording, using fake ids, and conspiracy.”
Secret Plotting Against Daleiden
It was April 5, 2016, two weeks after a secret meeting between Planned Parenthood California top executives and then-California AG Harris’s office, in which, according to e-mail records, requests for an “investigation” of Daleiden and seizure of his video equipment were discussed. That day, authorities raided Daleiden’s apartment and collected the undercover videos as well as additional unpublished materials and footage of Planned Parenthood’s criminal behaviors.
As delineated by Daleiden in an October 2020 Breitbart article, “apparently Kamala Harris had already decided that anyone selling body parts was innocent, and anyone exposing the sales, guilty.” Most certainly, Harris prosecuted Daleiden for the monumental implications of his message; in other words, to punish him for what he had to say about Planned Parenthood selling baby parts.
In the May 2020 lawsuit, Daleiden accuses Harris and Becerra — who, at the time, were the former and current California attorney general, respectively — of using a state video-recording law as a “political weapon” to silence free speech as a favor to Planned Parenthood, a close political ally. The framing of Daleiden as the criminal and Planned Parenthood as the victim is astounding.
Leave it to the Left to convolute the simple reality that abortion doctors and medical staff “huddled together” every morning to plan out the day’s cases, as to which lungs or livers would be the most profitable “line items” of the day. To take in the magnitude of the genocide against the unborn in America, one must view Daleiden’s videos.

- In the second video, Planned Parenthood’s Dr. Mary Gatter joked, “I want a Lamborghini,” as she negotiated the best price for baby parts.
- In the third video, Holly O’Donnell, a former Stem Express employee who worked inside a Planned Parenthood clinic, detailed first-hand the unspeakable atrocities and how she fainted in horror over handling baby legs.
- In the fourth video, Planned Parenthood’s Dr. Savita Ginde stated, “We don’t want to do just a flat-fee (per baby) of like, $200. A per-item thing works a little better, just because we can see how much we can get out of it.” She also laughed while looking at a plate of fetal kidneys that were “good to go.”
- In the fifth video, Melissa Farrell of Planned Parenthood-Gulf Coast in Houston boasted of Planned Parenthood’s skill in obtaining “intact fetal cadavers” and how her “research” department “contributes so much to the bottom line of our organization here, you know we’re one of the largest affiliates, our Research Department is the largest in the United States.”
- In the sixth video, Holly O’Donnell described technicians taking fetal parts without patient consent: “There were times when they would just take what they wanted. And these mothers don’t know. And there’s no way they would know.”
- In the seventh and perhaps most disturbing video, Holly O’Donnell described the harvesting, or “procurement,” of organs from a nearly intact late-term fetus aborted at Planned Parenthood Mar Monte’s Alameda clinic in San Jose, California. “You want to see something kind of cool,” O’Donnell says her supervisor asked her. “And she just taps the heart, and it starts beating. And I’m sitting here and I’m looking at this fetus, and its heart is beating, and I don’t know what to think.”
- In the eighth video, StemExpress CEO Cate Dyer admits Planned Parenthood sells “a lot of” fully intact aborted babies.
- The ninth video catches a Planned Parenthood medical director discussing how the abortion company sells fully intact aborted babies — including one who “just fell out” of the womb.

The video also shows the shocking ways in which Planned Parenthood officials admit that they are breaking federal law by selling aborted baby body parts for profit.

- The 11th video catches a Texas Planned Parenthood abortionist planning to sell the intact heads of aborted babies for research. Amna Dermish is caught on tape describing an illegal partial-birth abortion procedure to terminate living, late-term unborn babies which she hopes will yield intact fetal heads for brain harvesting.
- The 12th video in the series shows new footage of Jennefer Russo, medical director at Planned Parenthood in Orange County, California, describing to undercover investigators how her abortion business tries to harvest intact aborted babies’ bodies for a local for-profit biotech company and changes the abortion procedure to do so.

In 2020, the number of aborted babies in the United States rose to more than 60 million, and Planned Parenthood raked in more than $6.1 billion in profits. As Americans contend with ending this normalization of the murder of unborn children and these heinous crimes against humanity, they should also continue to support and stay apprised of Daleiden’s case. He is a hero who has suffered but remains steadfast in exposing the truth of Planned Parenthood.
