Barely had illegal-alien sanctuary city Chicago justified ignoring a federal detainer on an illegal alien, who then molested a three-year-old girl, than sanctuary New York did likewise. And in a very similar case.
As to the incident in Chicago, ICE slammed the sanctuary city after it released an illegal-alien who then raped the three-year-old. Mayor Lori Lightfoot, a radical leftist, blamed the immigration agency for the crime.
In New York, the Rotten Apple ignored a detainer and released a Guatemalan illegal accused of rape because he and the underage victim, a prosecutor says, were dating.
Despite his release, happily, Immigration and Customs Enforcement collared the rape suspect a few days ago.
The Suspect and the Detainer
The suspect there is Miguel Federico Ajqui-Ajtzalam, 20, whom cops arrested for second-degree felony rape and second-degree sexual contact with a kid under 14 years old.
He’s been in the country, ICE reported, since September 23, 2016, when he crossed the border illegally. “Immigration authorities processed [him] as an unaccompanied alien child (UAC), issued a Notice to Appear, and was released from ICE custody on Nov. 4, 2016 on an Order of Recognizance (OREC) pending removal proceedings.”
Of course, Ajqui-Ajtzalam disappeared, at least until he was arrested for the rape a few weeks ago on February 27. ICE, as per usual, filed a detainer, and New York, as per usual, let him go.
ICE captured the illegal-alien sex-crime suspect on March 2. He awaits a removal hearing. “It’s inconceivable that a individual who was arrested for local charges of rape and sexual abuse of a child, would be released back into the community instead of being transferred to ICE who had a detainer in place,” said Thomas Decker, the chief of New York’s Enforcement and Removal Operations branch.
It’s OK, She Consented!
The New York Post explained exactly what this Obama DREAMer did: He had “sex with the underage girl between October and December 2018, according to a complaint filed in Brooklyn Criminal Court. The girl was 13 at the time and he was reported on Feb. 22 of this year, police sources said.”
Shockingly, a 20-year-old man having sex with a 13-year-old girl wasn’t enough of a crime to keep him behind bars, the Post reported:
The Brooklyn DA’s Office defended the decision by saying that Ajqui-Ajtzalam and the victim were allegedly in a “relationship” at the time of the offenses.
“The case was reported by the girl’s mother, alleging that her daughter had a sexual relationship with an older teenager, which constituted statutory rape,” a spokesman told The Post.
A spokesman for the Office of Court Administration defended the judge’s decision by saying: “The District Attorney’s office requested supervised release and the Judge consented, agreeing that supervised release was the most appropriate and least restrictive form of bail to ensure the defendant’s return to court.”
And the cops restated their policy:
[NYPD] does not conduct civil immigration enforcement and we will only honor immigration detainers under the following circumstances: ICE presents a warrant issued by a federal judge establishing that there is probable cause to take the person into custody, and the person has been convicted of a “violent or serious crime” within five years of the arrest or is a possible match on the terrorist watch list.
Translation: New York City is not bound to enforce or obey federal immigration law, and will do its utmost to obstruct those laws, and harbor and aid and abet illegal-alien felons and felony suspects.
Philadelphia Case
ICE bagged another Guatemalan illegal-alien criminal releasee on March 3, the agency reported.
Cops had collared Eduardo Coc-Sep on October 10 for “robbery, theft by unlawful taking, receiving stolen property and other charges” and ICE, again, filed the usual detainer the very same day. But sanctuary Philadelphia released him on February 3.
Coc-Sep was yet another illegal arrested at the border then freed in the vain hope he might actually show up for an immigraiton hearing. “He was released with an electronic monitoring device which he subsequently cut off and absconded.”
ICE has filed subpoenas to pry information about illegal-alien thugs out of New York, Oregon, and other sanctuaries.
